Mass Tort Law

How The FDA Drug approval process doesn’t work

Most new medical products launched in the United States are authorized through a lesser-level FDA procedure that has been condemned as overly loose and which fails to examine whether the devices are safe and effective properly.

It typically takes less than a year for a medical device to go through the premarket approval process. The 510(k) premarket notification procedure (PMN) is by far the most common method for bringing new medical devices to market, and as you can imagine, has been widely criticized for how inconsistent this 510(k) Fast-Track approval has been for medical devices.

Pharmaceutical drugs and biologics are supposed to be designed to improve the quality of life for patients by keeping them healthy. While these medications have advantages for many people, they are unfortunately not risk-free for everyone.
