Disability Ratings and Benefits

The amount of compensation you receive depends on your disability rating, a percentage corresponding to the extent of your condition. Under the VA rating system, 100% represents a “whole efficient person.” The more a disability affects you, the higher your rating is likely to be. For example, someone with a condition affecting both legs is likely to have a higher rating than someone with a condition that affects just one leg.

You can use our disability calculator to estimate your monthly benefit. Assuming you’re married and have no dependent children or parents, here’s how much you might receive based on each rating:

  • 10%: $175.51
  • 20%: $$346.95
  • 30%: $601.42
  • 40%: $859.16
  • 50%: $1,208.04
  • 60%: $1,523.93
  • 70%: $1,908.19
  • 80%: $2,214.89
  • 90%: $2,489.96
  • 100%: $4,044.91

When Should I Get a VA Disability Lawyer?

You aren’t required to have a VA lawyer. You can fill out the paperwork and gather supporting documentation on your own. However, it’s helpful to have an experienced legal professional who stays current with the guidelines and gives you access to professional advice tailored to your unique situation. Who is best to help with a VA claim depends on the extent of your disability, your level of comfort with the paperwork and whether you’re filing an initial claim or an appeal.

The VA denies a significant percentage of initial claims, leaving veterans frustrated and wondering if it’s even worth it to appeal. Experienced Florida disability lawyers know how to review denied claims, identify missing information, and gather additional evidence.

Overturning VA Denials

It’s common for the VA to deny claims based on wrong or incomplete documentation, or due to a lack of nexus (the connection between military service and the disabling condition). Florida veterans typically fail to win VA benefits because of:

  • Weak or absent nexus evidence. If you can’t show how your in-service event caused your disability, the VA often denies your claim.
  • Incomplete medical records. The VA needs detailed documentation to confirm the severity and origin of your condition.
  • Errors in paperwork or late submissions. Failing to meet deadlines or including incorrect data can result in an immediate denial.
  • Navigating the process alone. Without a qualified attorney for VA appeals in Florida, you risk overlooking important details that can be the difference between a denial and an approval.
  • Misapplied ratings. Sometimes, the VA grants service connection but at a rating that doesn’t accurately reflect your impairment.

Successful Appeals for Florida Veterans

For an appeal to succeed, the VA typically looks for these elements:

  • An established, ongoing disability: You need a current condition diagnosed by a medical professional.
  • In-service injury or event: Service records, witness statements and official documents can verify when and how your disability began.
  • Treatment records: If you received treatment for your condition before retiring, you must submit your treatment records.
  • Nexus letter: The VA needs your doctor to write a Nexus letter detailing how your condition relates to your military service.
  • Consistent paperwork: Conflicting dates or missing medical forms can delay your case indefinitely.
  • Timely filing: The VA enforces deadlines for each appeal stage, so quick action is key.

How Long Does a VA Appeal Take With an Attorney?

There are several ways to contest a denial or dispute a rating:

  1. Higher-level review: A senior VA adjudicator reviews your case for errors, but no new evidence is considered at this stage.
  2. Supplemental claim: You add relevant and previously unsubmitted evidence to strengthen your claim.
  3. Board of Veterans’ Appeals (BVA): This is an in-depth process that can include a hearing before a Veterans Law Judge.
  4. Court of Appeals for Veterans Claims (CAVC): If the BVA doesn’t rule in your favor, you may escalate the matter to the CAVC, which examines legal and regulatory compliance.

Timelines for appealing a VA benefits decision vary, but veterans going it alone might wait more than 2 years. Some face multiple denials or requests for new evidence, dragging the process out even longer.

Partnering with a VA disability lawyer can significantly shorten these waits. Legal teams familiar with VA guidelines understand how to:

  • File required documents early. Getting ahead of VA requests can prevent avoidable delays.
  • Arrange timely medical exams. Some veterans wait months for the right evaluations. We coordinate them sooner.
  • Select the right appeal path. Not every case needs a Board of Veterans’ Appeals hearing.
